Your guide to Transgender Rights, Sexual Orientation and Gender Identity in South Africa

The rights of transgender people in South Africa are protected by the Constitution, along with sexual orientation and gender identity. As the first country in the world to provide constitutional protection to LGBT people, South Africa stands as a beacon of hope that all people live in a free, fair and equal society.

For trans gender people specifically, their rights to gender identity and expression are explicitly acknowledged and are protected from any form of discrimination by any person, or the state, on the basis of their sex, gender or sexual orientation.

In this video, as part of Transgender Awareness Week, we talk in depth about sexual orientation, gender identity, and gender expression, and we discuss the rights of transgender people in South Africa, including the legal framework around South Africa’s Constitution and the Bill of Rights, amending your gender marker with the Department of Home Affairs, as well as the experiences of trans people on the ground.
